What’s New?

In mid-December 2009, as authorized by Arizona Supreme Court Administrative Order No. 2009-43, the court began serving all case decisions (opinions, memorandum decisions, and decision orders) filed in criminal appeals pending in Division One of the Arizona Court of Appeals on counsel of record exclusively by e-mail. On January 21, 2010, web link e-mail distribution of case decisions to counsel expanded to Industrial Commission cases, Mental Health cases, Juvenile cases, Unemployment Board Appeal cases, Corporation Commission direct appeal cases, Habeas Corpus appeals, Tax appeals, and Special Actions. The Court will complete its transition to web link e-mail distribution of case decisions to counsel in all case types by adding Civil appeals to the process on March 1, 2010.

Service of case decisions will be in the form of an e-mail from Division One to each counsel of record. This e-mail will identify the affected case or cases, inform the recipient that a decision has been filed in the case, and will include a web link to the case decision on Division One's web site. This process will further expand in the future to encompass web link distribution of case decisions to counsel in all the court's remaining cases, including civil and family court appeals.

Additionally, though Administrative Order No. 2009-43 requires counsel filing in the state appellate courts only to "designate and maintain" a single e-mail address "to which official court documents will be sent," Division One has adopted the practice of including within its case management system's e-mail module any and all other distinct e-mail addresses supplied by or reliably attributed to the same counsel of record in addition to the required designated e-mail address. If the court has more than one e-mail address on file for a given attorney appearing before it, each item of e-mail for that attorney will be sent to all such addresses.
